"Mas, you should know. I'm pregnant with your child now, Mas. Your own flesh and blood" said Nelly, hoping Hariz could return to his arms.
Hariz is still flinching. In his little heart he refused with what Nelly just said. Right now he just wants to focus on giving his attention and love only to Dhena and Fathan, his precious little family in his life.
Especially if you remember what Nelly's mother did to Fathan, who almost hurt the life of his baby. His heart seemed to have been unable to forgive the evil deeds of his former father-in-law.
After nearly forty-five minutes Dhena was in the check room. He also came out with a white pelastic containing several kinds of drugs for him.
Her steps stopped when she saw her husband talking to a woman who turned her back to Dhena.
Dhena approached Fathan and then led her tiny hand towards Hariz who was still having a serious conversation with his interlocutor.
"Have you finished checking, dear? How did your midwife say you're healthy, right?" Hariz greets Dhena with a few questions that he deliberately asks Nelly to know if Dhena is pregnant.
Nelly turned her back. The two women sat with each other for a moment. Dhena's mouth gaped as she realized that from earlier Hariz talked and chatted with his ex-wife until Fathan was dicuekin and played alone in the swing.
Hariz immediately invites Dhena to leave the place regardless of the circumstances of Nelly who had asked Hariz to return to him because of his position is pregnant.
On the way to home. Hariz invites Dhena to stop by briefly at the house of one of Hariz's acquaintances who is a little religious. He wanted to ask him directly about some questions that stuck in his heart after he met Nelly.
Hariz parked his motorcycle in front of a house that looked simple but so neat and beautiful.
Hariz and his small family were immediately warmly welcomed by the host who looked very friendly very familiar. Enter and take a seat in the living room. Before long there was someone who brought me a few glasses of drink and a few snacks of wet cake.
"I'm sorry, Mr. Ustaz I would like to inquire about the law of divorcing women in pregnancy. Is it true that a husband is forbidden to look at a woman who is pregnant?" ask Hariz slowly. Coincidentally Dhena was taking Fathan to play outside the house with his wife who had a house on the front porch.
Ustaz Hasan was astonished by Hariz's question. But, he still tried to answer it clearly. He began to give a very long explanation.
"In a hadith narrated by Muslims it is told that Ibn Umar RA menalak his wife in the condition of menstruation. The incident was then told by Umar bin Khatthab RA to the Prophet of Allah SAW. Hearing the story, the Prophet asked Umar bin Khaththab RA to order his son to return to his wife. Only then if he still wants to divorce her, then divorce when in a sacred condition or pregnant."
"In a hadith that means more or less like this, “From Ibn Umar RA that he had menalak his wife in a state of menstruation. Then Umar bin Khatthab RA told the Prophet about the incident. Then he also said to Umar bin Khatthab RA, ‘The order to him (Ibn Umar RA) to return to his wife, then talk him in a state of holiness or pregnancy,” (HR Muslim).
"The order of the Prophet to Ibn Umar RA through his father, Umar bin Khaththab RA, was at least two important things.
First, the prohibition to menalak women in the state of menstruation. Second, the ability to lure women in a state of holiness or pregnancy. In line with this Muhyidin Sharaf An-Nawawi in his Muslim Sharah explained that the content of the hadith shows the ability to turn on pregnant women who are clearly pregnant. According to him, this is the view of Madzhab Syafi. Furthermore, according to Ibnul Mundzir, the view of Madzhab Syafi this is the opinion of the majority of scholars. Among them were Thawus, Al-Hasan, Ibn Sirin, Rabiah, Hammad ibn Abi Sulaiman, Malik, Ahmad, Ishaq, Abu Tsaur, and Abu Ubaid."
“Hadits shows the ability to turn a pregnant woman when it is clear her pregnancy. This is the view of Madzhab Syafi. Ibn al-Mundzir said, this view is also embraced by the majority of scholars, including Thawus, Al-Hasan, Ibn Sirin, Rabiah, Hammad ibn Abi Sulaiman, Malik, Ahmad, Ishaq, Abu Tsaur, among others, dan Abu Ubaid,” (See Muhyiddin Syarf An-Nawawi, Shahih Muslim bi Syarhin Nawawi, Cairo, Darul Hadits, 4th cet, 1422 H/2001 M, juz V, page 325). Ibnul Mundzir also agreed that the ability to turn on women who are pregnant. Likewise some scholars from the Maliki Madzhab. But there are also some scholars Madzhab Maliki forbid it. While other history includes, Al-Hasan argues that menalak women who are pregnant is makruh. ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ Mundzir said, I also think so. Likewise with some scholars from the Maliki Madzhab. Some others declared it illegal. Ibnul Mundzir also narrates another route from Al-Hasan. According to the history of this line, Al-Hasan argues that the menalak women who are pregnant are makruh,” (See Muhyiddin Sharaf An-Nawawi, Shahih Muslim bi Syarhin Nawawi, juz V, page 325). Departing from the explanation above, then we can draw the conclusion that the majority of scholars allow the tuning of women who are pregnant despite some stating that makruh and haram.
But the opinion that is considered strong is the opinion of the majority of scholars who allow the tuning of women who are pregnant. And the iddah for a pregnant woman who is ingested is until she gives birth to her womb as Allah says the following: ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ ⁇ That is, “Women who are pregnant their iddah time is until delivery of the womb,” (QS At-Thalaq [65]: 4). So more or less the answer from me Mr. Hariz, hopefully useful for njengan." Ustaz Hasan closed his long exposure to Hariz.
"If you may know, did Mr Hariz have a problem with Mr Hariz's wife? I see Mr. Hariz's wife is kind and beautiful. Time to be divorced?" Ustaz Hasan asked Hariz.
Hariz smiled at ustaz Hasan and said, "No ustaz, I don't want to divorce my wife."
At least after getting an answer that relieved his heart, Hariz was a little able to breathe a sigh of relief because he was not too burdened with the condition of Nelly today.
